1a. No spirit is willing to be bound for free. The expenditure of Gnosis during the rite represents the Garou transferring some of their energy to the spirit as payment. This is why spending Gnosis lowers the spirit's Gnosis rating. The spirit becomes more amenable to your demands the more you bribe it.

1b. I believe the spirit is aware. As the Garou is rolling Willpower, we can assume this rite represents a werewolf forcing their will upon a spirit. The Garou is not necessarily required to defeat a spirit, though this is always an option if the rite fails.
